MINUTES

The Johnsburg Sanitary District Commission met on Monday, April 3rd, 2006, at 9:00 a.m., at the Taycheedah Town Hall, for the purpose of conducting the April monthly meeting. Members present were President Franz Schmitz, Commissioner Dennis Lefeber and Recording Secretary Brenda Schneider. Commissioner Ken Schneider was absent.

1. Call to order. President Schmitz called the meeting to order at 9:07 a.m.
2. Approval of meeting minutes. The Commission reviewed the minutes of the 3/7/06 meeting. Hearing no objections, the President declared the minutes approved a presented.
3. Consideration and possible approval of a request for a new lateral stub submitted by Nick Pitzen for a lot located on Cty. W. Franz Schmitz motioned to approve the application for a new lateral stub contingent upon receipt of the $10,000.00 Licenses and Permits Bond and Certificate of Insurance from Town & Country by May 2nd, seconded by Dennis Lefeber. Motion carried (2-0-1 absent).
4. Consideration and possible action regarding the repair or replacement of a faulty lift station pump. The pump has been re-installed and seems to be working properly. Foth has contacted PTS regarding a report on the repairs made to the pump. Foth will forward the report to the Commission once it is received.
5. Discuss operational issues-odor complaints, etc. A charcoal filter has been installed on the roof vent of the Clement house. The Ablers have not experienced odor problems since a filter was installed on their roof vent. Dennis Steigenberger, Foth & Van Dyke, will be asked to evaluate the system for technical issues that could be contributing to the odor problem. The problem is being constantly investigated and solutions being sought.
6. Status report on connections. The report was as follows: 112 permits have been issued, 101 of the 112 structures have been connected and received final inspection and 11 remain to be connected. A few properties are connected and using the system but have yet to complete the necessary internal work for final inspection.
The deadline for connection of gravity-served property was July 15th, 2005 and the deadline for properties served by grinder pumps was August 11th, 2005. Section 6.01 of the Districtís Sewer Use Ordinance authorizes the Commission to cause a connection to be made six months after the deadline date. The Commission will continue to monitor the connections.
7. Discuss the Districtís debt retirement schedule. For the past two taxing cycles, the Commission has levied more than the annual debt payment with the intentions of paying more toward the principal balance in order to reduce the term of the bond. The Commission reviewed an analysis of the revenue sources currently held in the Debt Service Account and the scheduled debt payments. Dennis Lefeber motioned to pay $11,224.00, the equivalent of the 2004 excess tax revenue, toward the principal of the General Obligation Bond, seconded by Franz Schmitz. Motion carried (2-0-1 absent).
8. Consideration and possible action to amend the ordinance to establish a fee for special meetings to be paid by the individual(s) requesting the special meeting. A draft ordinance amendment will be presented at the next meeting.
9. Consideration and possible approval of the Districtís Vulnerability Assessment/Emergency Response Plan. Franz Schmitz motioned that the information contained in the document meets the criteria of a VA/ERP and to accept the document as presented, seconded by Dennis Lefeber. Motion carried (2-0-1 absent).
10. Status of the draft Operation & Maintenance Agreement with Taycheedah Sanitary District No. 1. The draft agreement was submitted to Taycheedah Sanitary District No. 1. President Dan Deuster, with their attorney, wants to meet with Franz, Brenda and Attorney John St. Peter for discussion purposes only. Attorney St. Peter will coordinate the meeting.
11. Discuss Taycheedah Sanitary District No. 1ís request for reimbursement for their generator project. A letter on behalf of all of the upstream parties was sent to TSD#1 reiterating their opinion that the upstream parties are not responsible for the reimbursement of the generator project.
12. Approval of District bills. Dennis Lefeber motioned to approve the bills (order nos. 29-38), seconded by Franz Schmitz. Motion carried (2-0-1 absent).
13. Schedule the next meeting. The next meeting will be held on Tuesday, May 2nd, at 9:00 a.m.
14. Commissionersí reports and comments. The OSG semi-annual meeting will be held on April 20th, at 2:00.
15. Adjournment. Dennis Lefeber motioned to adjourn at 10:45 a.m., seconded by Franz Schmitz. Motion carried (2-0-1 absent).
