MINUTES

The Town of Taycheedah Comprehensive Planning Committee met on Thursday, July 21st, 2011, at 6:30 p.m., at the Taycheedah Town Hall. Members present were: Ed Braun, Neal Nett, Rebecca Ries, Brenda Schneider, Joanne Thome, Joe Thome and Mike Wirtz. Absent was Jerry Guelig. Excused was Tim Krawczyk. Also present was one interested person.

1. Call to Order. Chairman Ed Braun called the meeting to order at 6:38 pm.

2. Approval of the minutes of the 6/20/11 meeting. Mike Wirtz motioned to approve the minutes of the 6/20/11 meeting, seconded by Joe Thome. Motion carried (7-0-2 absent).

3. Review and discuss revisions to the Code of Ordinances and the Comprehensive Plan.

The following revisions to the Zoning Ordinance were recommended by the Committee:

Section 13-1-8(b)(4)(a), Accessory use, farmland preservation agricultural district. Delete This may include, for example:. Also delete bullets (1) thru (7). The revised Section (4)(a) will read as follows: A building, structure, or improvement that is an integral part of, or is incidental to, an agricultural use.

Section 13-1-8(b)(4)(e), Accessory use, farmland preservation agricultural district. New bullet to read as follows: Any other use that the Department of Agriculture, Trade and Consumer Protection, by rule, indentifies as an agricultural use.

Section 13-1-8(b)(9)(j), Agricultural Use. New bullet to read as follows: Any other use that the Department of Agriculture, Trade and Consumer Protection, by rule, identifies as an agricultural use.

Section 13-1-8(b)(10)(a), Agriculture-related Use, farmland preservation district(s). Delete the phrase directly to farms.

Section 13-1-8(b)(10)(b), Agriculture-related Use, farmland preservation district(s). Delete the phrase obtained directly from farms.

Section 13-1-8(b)(10)(e), Agriculture-related Use, farmland preservation district(s). Delete the phrase received directly from farms.

Section 13-1-8(b)(17), Base Farm Tract. Add the following sentence: Any other tract that the Department of Agriculture, Trade and Consumer Protection, by rule, defines as a base farm tract.

Section 13-1-8(b)(35), Contiguous. Add the following sentence: Parcels are not contiguous if they are separated by municipal boundaries.

Section 13-1-8(b)(47), Farm. Delete For purposes of this definition, land is deemed to be primarily devoted to agricultural use if any of the flowing apply:. Also delete bullets (a) and (b). The revised Section (b)(47) shall read All land under common ownership that is primarily devoted to agricultural use.

Section 13-1-8(b)(48), Farm Acreage. Delete entire definition as printed including (a) and (b). Substitute with the following: The size of the farm in acres.

Section 13-1-8(b)(59), Gross Farm Revenue. Clarify the purpose of including financial program qualifications in the Taycheedah Zoning Ordinance. Also, clarify any relationship to (47) Farm.

Section 13-1-8(b)(87), Nonfarm Residential Acreage. Clarify the reference to 10 acres residential parcels.

Section 13-1-8(b)(95), Person. Clarify whether or not a person(s) operating under more than one LLC are considered separate "person" and therefore, will have separate farm tracts for each LLC.

Section 13-1-8(b)(101)(c), Protected Farmland. Remove the misplaced (.

Section 13-1-8(b)(123), Use Consistent with Agricultural Use. Verify the statutory reference is correct.

Section 13-1-52(c)(1), Agricultural Uses and Accessory Uses. Delete the following phrase: Agricultural uses and accessory uses on farms, except that a conditional use permit is required under section for the flowing agricultural uses and accessory uses on farms:.

Section 13-1-52(c)(2), Nonfarm Residences. Remove from subsection (c), Permitted Uses. Insert as subsection (d)(2)(a)(3), Conditional Uses, Nonfarm Residences.

Section 13-1-52(c)(3), Undeveloped natural resource and open space areas. Renumber to (2). Also capitalize the z in zoning and the o in ordinance.

Section 13-1-52(c)(4), Transportation, Utilities, Communication Facilities. Renumber to (3).

Section 13-1-52(c)(5), Pre-Existing Residences and Residential Lots. Renumber to (4).

Section 13-1-52(c)(3), Transportation, Utilities, Communications Facilities. Revise the first sentence by inserting the words cell phone towers and wind turbines so that it states the following: Transportation, utility, communication, cell phone towers, wind turbines, and other uses....

Section 13-1-52(d)(1), General. Change the two references to the Plan Commission to the Board of Appeals.

Section 13-1-52(d)(2), Nonfarm Residences. Change the one reference to the Plan Commission to the Board of Appeals.

Section 13-1-52(d)(2)(a)(2). Change the minimum lot size for a nonfarm residence from 3 acres to 1 1/2 acres. Clarify the minimum acres owned if the owner elects to sell a larger parcel for a nonfarm residence as it applies to the 1:20 ratio.

Section 13-1-52(d)(2)(a)(3). Change the number of allowable nonfarm residences from one to two. Clarify if a retiring farmer plans to split the home/barn from the cropland; farm residence vs. nonfarm residence and it application to the limitation of no more than two nonfarm residences.

Section 13-1-52(d)(2)(b). Revise (b) to mirror 91.46(2)(c), The location and size of the proposed nonfarm residential parcel, and, for a new nonfarm residence, the location of the nonfarm residence on that nonfarm residential parcel, will not do any of the following:

Section 13-1-52(d)(2)(b)(1). Revise (1) to mirror 91.46(2)(c)(1), Convert prime farmland from agricultural use or convert land previously used as cropland, other than a woodlot, from agricultural use if on the farm there is a reasonable alternative location or size for a nonfarm residential parcel or nonfarm residence.

Section 13-1-52(d)(3), Nonfarm Residential Clusters. Clarify the reasoning.

Section 13-1-52(d)(4), Agricultural and accessory uses on farms. Change the one reference to the Plan Commission to the Board of Appeals.

Section 13-1-52(d)(4)(b) thru (t). Move these listed agricultural uses from conditional uses to permitted uses (c)(1)(e) thru (w).

Section 13-1-52(d)(5), Agricultural-related Uses. Change the one reference to the Plan Commission to the Board of Appeals.

Section 13-1-53(f), Standards for Rezoning. Correct the Zoning Ordinance reference from 13-1-52(f) to 13-1-52(e).

Section 13-1-58, Overlay Districts. The Committee will discuss the Overlay Districts section during their next meeting.

4. Schedule the next meeting. The next Committee meetings will be held on Monday, August 22nd (without Mr. Sanders) and a meeting in September with Mr. Sanders will be scheduled. Both meetings will begin at 6:30 pm.
