MINUTES

The Town of Taycheedah Comprehensive Planning Committee met on Monday, August 22nd, 2011, at 6:30 p.m., at the Taycheedah Town Hall. Members present were: Ed Braun, Neal Nett, Rebecca Ries, Brenda Schneider, Joanne Thome, Joe Thome and Mike Wirtz. Absent was Jerry Guelig. Excused was Tim Krawczyk. Also present was one interested person.

1. Call to Order. Chairman Ed Braun called the meeting to order at 6:33 pm.

2. Review and discuss revisions to the Code of Ordinances and the Comprehensive Plan.

It was reported to the Committee that Mr. Sanders obtained the sample Working Lands Initiative compliant ordinance language from a sample ordinance developed by DATCP.

The following previously recommended revisions were further discussed based upon guidance from Mr. Sanders:

Section 13-1-8(b)(87), Nonfarm Residential Acreage. The reference to 10 acres, which was recommended for deletion, would apply to the ability for a farmer to sell/give a lot to an heir. The 1:20 ration would apply to the heir's lot. The Committee has the authority to allow or not allow such lots. Committee recommendation was to delete the 10 acre reference.

Section 13-1-52(c)(1)(a). Substitute the word more with the word less. The revised phrase will state in part.....if that facility will have less than 500 animal units.

Section 13-1-52(c)(1)(e) thru (c)(1)(w). Delete the following agricultural uses and accessory uses due to the fact that (a) summarizes all of them or the fact that the programs are believed to be out-dated: (f) commercial feedlots; (g) dairying; (h) egg production; (l) grazing; (m) livestock raising; (p) poultry raising; (t) placing land in federal programs in return for payments in kind; (u) owning land, at least 35 acres of which is enrolled in the conservation reserve program under 16 USC 3831 to 3836; and, (v) participating in milk production termination program under 7 USC 1446(d);

Section 13-1-52(c)(1)(g), Fish or fur farming. Re-locate fur farming to (d)(4)(b) Conditional Uses. Retain fish farming as a permitted use.

Section 13-1-52(d)(4)(a). Verify the impact of Ch. ATCP 51, Wis. Adm. Code, on agricultural uses.

Section 13-1-52(d)(9)(b). Nonmetallic mineral extraction. The operation and its location in the EA/FP zoning district are consistent with the purposes of the farmland preservation zoning district. Clarify whether or not a quarry operation can meet this requirement. Also, clarify if this stipulation can be removed.

Section 13-1-53(b), Lands Included Within This District. Substitute the word possible in place of expected to occur.

Section 13-1-58(a), General. Delete the phrase protect a specific resource or.

Section 13-1-58(b)(3), CA-Critical Overlay District. Delete this entire category.

Section 13-1-58-A(c), Conditional Uses. Change Zoning Administrator to Zoning Administrator/Permit Issuer.

Section 13-1-58-A, MRC-Mixed-Use Residential/Commercial Overlay. Insert (a), (b), and (c) under Section 13-1-58(b)(1).

Section 13-1-58-B, MCI-Mixed Commercial/Light Industrial Overlay. Insert (a), (b), and (c) under Section 13-1-58(b)(2).

Section 13-1-58-C, CA-Critical Areas Overlay. Delete this section in its entirety.

Section 13-1-59(b)(2), TRD-Transitional Residential District. Transfer from a permitted use to Section 13-1-59(c) Conditional Uses.

Section 13-1-59(b)(3)(a). Revise so that the entire subsection reads as follows: The home shall be at least twenty-four (24) feet in width and forty-two (42) feet in length.

Section 13-1-59(b)(3)(c). Revise so that the entire subsection reads as follows: The home shall be installed on an approved foundation system in conformity with the Uniform Building Code. The wheels and axles must be removed. The enclosed foundation system shall be approved by the Building Inspector and/or Town Engineer. The Building Inspector may require a plan to be certified by a registered architect or engineer to ensure proper support for the home.

Section 13-1-59(b)(3)(d). Delete subsection in its entirety.

Section 13-1-59(b)(3)(d). Revised subsection (d) shall be stated as follows: The home shall be equipped with foundation siding which in design, color and texture appears to be an integral part of the adjacent exterior wall of the manufactured home.

Section 13-1-59(b)(3)(e). New subsection shall be stated as follows: The home shall be covered with a roof pitched at a minimum slope of three (3) inches in twelve (12) inches, which is permanently covered by non-reflective material. Refer to Section 13-1-25, Roof Slopes and Eaves Dimensions for Dwelling, Accessory Buildings and Garages.

Section 13-1-59(b)(3)(f). New subsection shall be stated as follows: The home shall be covered with a pitched roof, overhanging eaves and such other design features required of all new single-family dwellings located within the Town of Taycheedah. Refer to Section 13-1-25 Roof Slopes and Eaves Dimensions for Dwelling, Accessory Buildings and Garages.

Section 13-1-59(c)(3), Multiple family dwellings. Delete section in its entirety.

Section 13-1-59(d)(1)(a), Occupancy. Delete subsection in its entirety.

Section 13-1-59(d)(1)(b), Location. Substitute 50 feet in place of 150 feet.

Section 13-1-59(d)(1)(c), Ground Floor Area. Revise so that the entire subsection states the following: The minimum ground floor area per dwelling unit shall be one thousand eight (1,008) square feet for one-story, nine hundred (900) square feet for split level, and eight hundred (800) square feet for two-story dwellings; one-half (1/2) vertical measurement of story must be above ground level.

Section 13-1-59(d)(1)(d), Off Street Parking Space. Delete this entire subsection due to the fact that it would apply solely to multi-family structures.

Section 13-1-59(d)(1)(e), Preserved Open Space. Delete subsection in its entirety.

Section 13-1-59(e), Dimensions of Building Sites for Unsewered 1 and 2 Family Units. Delete the word Unsewered.

Section 13-1-59(e)(1). Revise so that the entire subsection states the following: The minimum lot area shall be one-half (1/2) acre for each parcel created within a conservation design subdivision consistent with and as described in the Town of Taycheedah Land Division and Subdivision Ordinance, when amended; one-half (1/2) for each parcel created within a traditional subdivision served by a sanitary sewer collection system; or one (1) acre for each parcel created within a traditional subdivision not served by a sanitary sewer collection system.

Section 13-1-59(e)(2), Garage floor area. Delete subsection in its entirety.

Section 13-1-59(e)(3). Revise so that the entire subsection states the following: Where soil conditions are such as to require larger lot sizes for subdivisions of land under the provisions of applicable County ordinances and State law, then such larger lot sizes shall be considered as required by the Zoning Code.

Section 13-1-59(e)(4). Substitute the phrase not exceed thirty-two (32) feet nor two and one-half (21/2) stories in place of 35 feet or 21/2 stories. Also add the following phrase: Refer to Section 13-1-150 Height Modifications.

Section 13-1-59(e)(5). Substitute the phrase all dwellings in place of buildings not over 1 1/2 stories in height, Also correct the type or should be of.

Section 13-1-59(e)(6). Delete this entire subsection.

Section 13-1-59(e)(8). Correct the reference to Section 11 to Section 13-1-24. Delete the word generally and the phrase and more specifically as follows:.

Section 13-1-59(e)(8)(a) and (b). Delete the two subsections in their entirety.

Section 13-1-59(e)(9). Delete subsection in its entirety.

Section 13-1-59(e)(10). Delete subsection in its entirety.

Section 13-1-59(f), Substandard Lots. Delete section in its entirety.

Section 13-1-40(a)(17). Add Overlay Districts including MRC and MCI.

Section 13-1-40(a)(18). Add TRD-Transitional Residential District.

Section 13-1-43(d)(1)(a), R-2 Single-Family Residential District without Public Sewer.
Substitute the words forty-three thousand five hundred sixty (43,560) square feet (1 acre) in place of sixty-five thousand three hundred forty (65,340) square feet (11/2 acres).

Section 13-1-45(d)(1)(a), R-4 Two-Family Residential District without Public Sewer. Substitute the words forty-three thousand five hundred sixty (43,560) square feet (1 acre) in place of sixty-five thousand three hundred forty (65,340) square feet (11/2 acres).

Section 13-1-47(d)(1)(a), R-6 Single-Family and Two-Family Residential District without Public Sewer. Substitute the words forty-three thousand five hundred sixty (43,560) square feet (1 acre) in place of sixty-five thousand three hundred forty (65,340) square feet (11/2 acres).

3. Schedule the next meeting. The next Committee meeting will be held on Thursday, September 15th, (with Mr. Sanders) beginning at 6:30 pm.

4. Public Comment.

5. Adjournment. Joe Thome moved to adjourn at 9:27 p.m., seconded by Rebecca Ries. Motion carried (7-0-2 absent).
