TOWN OF TAYCHEEDAH COMPREHENSIVE PLAN
AMENDMENT #1

PLEASE TAKE NOTICE that the Town of Taycheedah Plan Commission will conduct a public hearing on Tuesday, August 13th, 2013, at 6:00 p.m., at the Taycheedah Town Hall, W4295 Kiekhaefer Parkway, Fond du Lac, for the purpose of gathering testimony pertaining to proposed amendments to the Town of Taycheedah Comprehensive Plan and to make a recommendation to the Taycheedah Town Board regarding the following proposed amendments to the Town of Taycheedah Comprehensive Plan:

Revise the description of Proposed Rural Residential to allow for individual, large-lot development and conservation subdivisions within the area between the Niagara Escarpment and Lake Winnebago, and
Change the future land use designation of Parcel #T20-16-18-32-05-018-00 and Parcel #T20-16-18-32-05-019-00, a total of 3.41 acres, owned by Old Mill Plaza, LLC, located in Peebles, from Commercial to Multi-Family.

PLEASE TAKE FURTHER NOTICE that the Taycheedah Town Board will conduct a special meeting of the Town Board, on Tuesday, August 13th, 2013, at the Taycheedah Town Hall, W4295 Kiekhaefer Parkway, Fond du Lac, immediately following the public hearing, for the purpose of considering and taking action on the Town of Taycheedah Plan Commission's recommendation and the oral testimony presented during the public hearing, and to adopt the amendments to the Town of Taycheedah Comprehensive Plan.

PLAN COMMISSION
PUBLIC HEARING
COMPREHENSIVE PLAN AMENDMENTS
TUESDAY, AUGUST 13, 2013
6:00 P.M.
TAYCHEEDAH TOWN HALL

Members present were Chairman John Wagner, Bud Sabel, Joan Simon, Tim Simon, Joe Thome and Secretary Brenda Schneider. Excused were Leon Schneider and William Spieker.

Chairman Wagner called the public hearing to order at 6:10 pm.

The purpose of the public hearing was to make a recommendation to the Town Board regarding the following proposed amendments to the Town's Comprehensive Land Use Plan:

Revise the description of Proposed Rural Residential to allow for individual, large-lot development and conservation subdivisions within the area between the Niagara Escarpment and Lake Winnebago, and
Change the future land use designation of Parcel #T20-16-18-32-05-018-00 and Parcel #T20-16-18-32-05-019-00, a total of 3.41 acres, owned by Old Mill Plaza, LLC, located in Peebles, from Commercial to Multi-Family.

The Plan Commission heard the following comments regarding conservation subdivisions:
Conservation subdivision development is a good option to offer in lieu of conventional development.
The proposal is to rezone two parcels between Tim's Alignment and the former restaurant; not all of Peebles.
Neal Nett, Comprehensive Planning Committee Member, explained the concept of conservation subdivision design.
The Future Land Use map was displayed and the area under consideration for the conservation subdivision option was delineated.

Seeing no further comments or questions, motion by Joe Thome, second by Bud Sabel, to recommend the Town Board amend the Comprehensive Plan to allow for conservation subdivisions in the Proposed Rural Residential District between the Niagara Escarpment and Lake Winnebago. Motion carried (5-0).

The Plan Commission heard the following comments and questions regarding the future land use designation of two parcels owned by Old Mill Plaza, LLC:
The property is currently planned and zoned for business.
Residential units are a permitted use in business zoning under certain conditions.
The project is planned to be sewered.
The property is not zoned or planned for single-family residential.
The Comprehensive Plan and future land use designations were explained.
The Town's Zoning Ordinance allows for no more than 12 units per acre and at least 20% open space. Also, any buildings on business zoned property could be as tall as 60 feet.

Public comments were as follows:
 The well for the project could jeopardize the existing wells.
 The potential that the retention pond would be a breeding ground for mosquitoes and the possibility of children drowning in it. It was noted that retention ponds are regulated by the DNR.
 The development would add 50 more vehicles to the flow of traffic in an area of Cty. WH that is narrower and includes traffic from North and South Peebles Lane, the daycare and Hidden Prairie.
 Peebles Lane has never been fixed and needs repair.
 The project will bring riffraff, drug runners and pedophiles to the area.
 Property values will decrease.
 People come to the area for space; they don't want crowding.
 The preference was to keep it vacant or use it for commercial; noise during the day and peaceful at night. Storage units were suggested. The buildings would be low to the ground and low traffic flow.
Mr. Ziegler indicated that he will move forward with business structures with residential above the first story.
He noted that the property had been for sale for seven years; no one was interested in buying it for commercial purposes.

Motion by John Wagner, second by Joe Thome, to recommend the Town Board approve the request submitted by Old Mill Plaza, LLC, to amend the future land use designation of his two parcels in Peebles, as noted in the Comp Plan, from Business with Public Sewer (B-2) to Multi-Family (MFR). Motion carried (3-2-2 absent). Nay-Joan Simon and Tim Simon.

Motion by John Wagner, second by Bud Sabel, to adjourn at 7:02 p.m. Motion carried (5-0-2 absent).

IMMEDIATELY FOLLOWING THE PLAN COMMISSION PUBLIC HEARING
TAYCHEEDAH TOWN HALL


Members present were Chairman Jerry Guelig, Supervisors John Abler, Clarence Kraus, Tim Simon and Mike Wirtz and Clerk Brenda Schneider.

Chairman Guelig called the meeting to order at 7:02 p.m.

Hearing no further questions, motion by Chairman Guelig to accept the recommendation from the Plan Commission and approve the request submitted by Old Mill Plaza, LLC, to amend the future land use designation of the two parcels in Peebles, as noted in the Comp Plan, from Business with Public Sewer to Multi-Family. Motion died for lack of a second.

Hearing no further questions, motion by Mike Wirtz, second by John Abler, to accept the recommendation from the Plan Commission and approve the amendment to the Comprehensive Plan to allow for conservation subdivisions in the Proposed Rural Residential District between the Niagara Escarpment and Lake Winnebago. Motion carried (5-0)

Motion by Mike Wirtz, second by Clarence Kraus, to adjourn the special meeting at 7:07 p.m. Motion carried (5-0).
