NOTICE OF PUBLIC MEETING

PLEASE TAKE NOTICE that the Town of Taycheedah Zoning Board of Appeals will conduct a public hearing on Thursday, July 13th, 2017, at 6:00 p.m., at the Taycheedah Town Hall, for the purpose of considering the request of Northeast Asphalt, Inc. to renew their Conditional Use Permit. The Conditional Use Permit to quarry in the Town of Taycheedah applies to the following property:

Commencing at the Northeast corner of the SE 1/4 (East 1/4 Post) of Section 16, Township 16 North, Range 18 East, and running as follows: thence North 89* 08' 52" West along the North line of the SE 1/4 of said Section 16, 1,324.91 feet to the property line and the Place of Beginning for the description of this parcel; thence continuing North 89* 08' 52" West along the North line of the SE 1/4 of said Section 16, 1,324.91 feet to the North-South Quarter line; thence North 89* 59' 23" West, along the North line of the SW 1/4 of said Section 16, 518.63 feet; thence South 1* 17' 32" East, 703.88 feet; thence South 89* 22' 41" East, 1,829.58 feet to the East line of the NW 1/4 of the SE 1/4 of said Section 16 and the property line; thence North 0* 09' 33" West along the East line of the NW 1/4 of the SE 1/4 of said Section 16, 703.76 feet to the Place of Beginning, and containing 29.780 acres (1,297,221 square feet) of land more or less

Immediately following:

PLEASE TAKE NOTICE that the Town of Taycheedah Zoning Board of Appeals will conduct a public hearing on Thursday, July 13th, 2017, at 6:00 p.m., at the Taycheedah Town Hall, for the purpose of considering the request of Daniel & Tim Simon and Northeast Asphalt, Inc. to renew their Conditional Use Permit. The Conditional Use Permit authorizes Simon to conduct mineral extraction operations on a parcel of land in the Town of Taycheedah to the following property:

The Southwest Quarter of the Northeast Quarter (SW 1/4, NE 1/4) and the Southeast Quarter of the Northwest Quarter (SE 1/4, NE 1/4) of Section 16, Township 16 North of Range 18 East, excepting therefrom the following:

A part of the Southeast Quarter of the Northwest Quarter of Section 16, Township 16 North, Range 18 East, Town of Taycheedah, Fond du lac County, State of Wisconsin and more particularly described as follows:

Commencing at the Southwest corner of the Southeast Quarter of the Northwest Quarter, Section 16 assuming for purposes of this description that the West line of the Southeast Quarter of the Northwest Quarter of Section 16 has a bearing of due North and South, measure due North along said West line, 24.75 feet to the point of intersection of said West line with the centerline of County Trunk Highway Q, said point being the point of beginning of this description; thence North 50 degrees, 39 minutes East, 329.90 feet on the main chord of a curve of radius, 260.15 feet, said radius point being Northwest of said curve; thence North 11 degrees, 59 minutes East 294.90 feet on the centerline of County Trunk Highway Q; thence North 15 degrees, 48 minutes East, 225.00 feet on the centerline of County Trunk Highway Q; thence South 89 degrees, 09 minutes East and parallel with the North line of said quarter-quarter section, 390.05 feet; thence due North and parallel with the West line of said quarter-quarter section, 598.30 feet to the North line of said quarter-quarter section; thence North 89 degrees, 09 minutes West 767.92 feet along the North line of said quarter-quarter section to the Northwest corner of said quarter-quarter section; thence due South along the West line of said quarter-quarter section, 1316.40 feet to the point of beginning of this description and containing 15.055 acres of land, more or less; subject to the rights of the public in and over that part of the above described land lying in the right of way of County Trunk Highway Q.

MINUTES

Minutes of Board of Appeals Public Hearing
July 13, 2017


CALL TO ORDER
The meeting was called to order at 6:00 p.m. at the Town Hall. Present were Board of Appeals members Jerome Bord, John Buechel, Tim Marcoe, Joe Sabel and Jason Meyer. Also present were Town Clerk Kris Marcoe, representatives of Northeast Asphalt, Inc., as well as various members of the public. The Town Clerk confirmed open meeting notice.

NORTHEAST ASPHALT'S PRESENTATION- SIMON QUARRY:
Matt Matuszak spoke on behalf of Northeast Asphalt Inc. and explained that Northeast Asphalt is seeking renewal of its previous permit with no requested changes to operations. Northeast Asphalt Inc. is seeking a 10-year renewal term. The quarry is a clean fill operation by DNR standards.

PUBLIC COMMENTS AND TESTIMONY
No public comments or testimony.


BOARD DISCUSSION/ACTION
A motion was made, seconded, and passed to approve the permit on the following terms:

A. The active quarry area shall be defined based on what the Reclamation Plan identifies as the permitted area and remove the Town of Taycheedah bonding requirements.

B. The permit term will be 10 years beginning with May 30, 2017.


NORTHEAST ASPHALT'S PRESENTATION - NEA QUARRY
Matt Matuszak spoke on behalf of Northeast Asphalt Inc. and explained that Northeast Asphalt is seeking renewal of its previous permit with no requested changes in operations. Northeast Asphalt Inc. is seeking a 10-year renewal term. Mr. Matuszak indicated that Northeast Asphalt, Inc. requested the renewal permit, if granted, be dated May 30, 2017. This date would coincide with the Simon Quarry permit and renew simultaneously in the future.

PUBLIC COMMENTS AND TESTIMONY
No public comments or testimony.

BOARD DISCUSSION/ACTION
A motion was made, seconded, and passed to approve the permit on the following terms:

A. The active quarry area shall be defined based on what the Reclamation Plan identifies as the permitted area and remove the Town of Taycheedah bonding requirements.

B. The permit term will be 10 years beginning with May 30, 2017.

ADJOURNMENT No other business coming before the Board, a motion was made and seconded with unanimous approval to adjourn.
